1. General Provisions
These Terms of Service govern the use of sittersandtutors.com and the services provided by Individual Entrepreneur (IE) Svetlana Khavanova (the Agency). By using the website and ordering services, you (the Client) agree to these Terms.
2. Nature of Services
- The Agency provides services for searching and selecting domestic staff (nannies, governesses, housekeepers, tutors, etc.).
- The Agency acts solely as an intermediary between the Client and the Candidate.
- The Agency is not the employer of the Candidates.
3. Payment Terms
Payment consists of two parts — a fixed manager service fee and an agency commission for successful placement.
- USD 240 (two hundred and forty) — payable on the day the agreement with the Agency is concluded. Payment is made in Russian rubles in an amount equivalent to USD 240 at the official exchange rate of the Central Bank of the Russian Federation (CBRF) on the date of payment.
- 50% (fifty percent) of the Candidate’s monthly salary — payable after successful placement of the Candidate.
All payments are made as agreed with the Agency. The Client bears bank fees and transfer charges.
3.1. Commission Refund Conditions
The personnel selection manager service fee of USD 240 is non‑refundable and is credited as payment for the Contractor’s organizational services, including search, preliminary screening, and presentation of candidates.
The Agency’s commission is refundable only in exceptional cases and subject to documented proof. A refund is possible in the following situations:
- The Candidate selected by the Agency did not start work on the agreed date.
- The Candidate refused to continue within 3 calendar days after the start date (probation period).
- The Candidate provided knowingly false information (forged documents, misleading references, etc.).
- A technical error occurred or the commission was charged twice.
In all other cases, the commission is non‑refundable.
3.2. Alternative Guarantee
Instead of a refund, the Agency provides a replacement Candidate for a similar position within the warranty period specified in the contract.
To request a refund or replacement, the Client must submit a written application stating the reason and attaching supporting documents to the Agency’s email. Applications are reviewed within 10 business days.
4. Client Responsibility
- Provide the Agency with complete descriptions of the vacant position, candidate requirements, and the employment terms.
- No later than 3 business days after interviewing each candidate, make a hiring decision and inform the Agency by phone or in writing (by mail or electronic means).
- Employment relations between the Client and the Candidate are established directly and are governed by the law of the country where the Candidate will work.
6. Confidentiality and Personal Data
By using the Website, the Client consents to the processing of personal data in accordance with our Privacy Policy. The Agency collects and uses only the data voluntarily provided by the Client via the contact form.
7. Changes to Terms
The Agency may amend these Terms. The updated version is published on the Website and takes effect upon posting.
8. Applicable Law
These Terms are governed by the laws of the Russian Federation. Disputes are resolved through negotiations, and if impossible — in court at the place of registration of the IE.
