Terms of Service

1. General Provisions

These Terms of Service govern the use of sittersandtutors.com and the services provided by Individual Entrepreneur (IE) Svetlana Khavanova (the "Agency"). By using the website and ordering services, you (the "Client") agree to these Terms.

2. Nature of Services

The Agency provides services for searching and selecting domestic staff (nannies, governesses, housekeepers, tutors, etc.). The Agency acts solely as an intermediary between the Client and the Candidate and is not the employer of Candidates.

3. Payment Terms

The fee consists of two parts — a fixed fee for the manager's services and an agency commission for a successful placement:

• USD 240 (two hundred and forty US dollars) — paid on the day the contract with the Agency is concluded. Payment is made in roubles in an amount equivalent to USD 240 at the official exchange rate of the Central Bank of the Russian Federation on the payment date.
• 50% (fifty percent) of the Candidate's monthly salary — paid after a successful placement of the Candidate.

All payments are made in the manner agreed with the Agency. The Client bears any bank fees and transfer costs.

3.1. Commission Refund Terms

The manager's fee of USD 240 is non-refundable and counts as payment for the Contractor's organisational services, including search, pre-screening and presentation of candidates.

The Sitters and Tutors agency commission is refundable only in exceptional cases and with documentary evidence. A refund is possible in the following situations:

• The candidate placed by the agency did not start work on the agreed date.
• The candidate declined to cooperate within 3 calendar days of starting work (probation period).
• The candidate provided knowingly false information about themselves (forged documents, false references, etc.).
• A technical error or double charge of the commission occurred.

In all other cases the commission is non-refundable.

3.2. Alternative Guarantee

Instead of a refund, the Agency provides a replacement candidate for a similar vacancy within the guarantee period — 6 (six) months from the date the contract is concluded.

To request a refund or replacement, the Client must send a written request stating the reason with supporting documents to the Agency's email. Requests are reviewed within 10 business days.

4. Client's Responsibilities

• Provide the Agency with full descriptions of the vacant position, candidate requirements and the terms of employment.
• Within 3 business days of interviewing each candidate, decide on hiring and inform the Agency by phone or in writing.
• The Client independently verifies the Candidate's qualifications, work experience, references and legal status (visa, work permit, etc.).
• The employment relationship between the Client and the Candidate is established directly and governed by the law of the country where the Candidate will work.

5. Confidentiality and Personal Data

By using the Site, the Client consents to the processing of personal data in accordance with our Privacy Policy. The Agency collects and uses only the data the Client voluntarily provides through the contact form.

6. Changes to the Terms

The Agency may amend these Terms. The updated version is published on the Site and takes effect upon posting.

7. Governing Law

These Terms are governed by the law of the Russian Federation. All disputes are resolved through negotiation and, failing that, in the court at the place of the IE's registration.
